Welcome to blimphomes.com, the website (“Website”) owned and operated by Blimp Homes Inc. (“Blimp”, “we”, or “us”). Blimp values and respects your privacy. We take the protection and security of the information you provide to us very seriously.

DEFINITIONS

For purposes of this Privacy Policy, capitalized terms shall have the meaning set forth below:

  • “Account” means your unique profile created using your email address and password and used to login to the Services.
  • “App” means the real estate transaction collaboration mobile application developed and provided by Blimp.
  • “Personal Information” means any information that can be used to personally identify you, including but not limited to your name, mobile number, mailing address, email address, username and password, geolocation, or demographic information.
  • “Services” means the real property listing search portal and other features made available via the Website.
  • “Third-Party Site” means the website, mobile application, or software not owned or controlled by Blimp.
  • “Usage Data” means anonymous data about your use of the Website collected via automated means which cannot be used to personally identify you, including but not limited to your type of browser, pages viewed, referring and exiting pages, the time and date of your visit to the Website, your internet protocol (IP) address, and mobile operating system.

CONSENT TO POLICY

This Privacy Policy discloses how we collect, use, and share information we obtain from you. By accessing the Website, using the Services, or providing us with Personal Information (as defined above), you accept the terms of this Privacy Policy and consent to the collection and use of your Personal Information as described in this Privacy Policy.

COLLECTION AND USE OF PERSONAL INFORMATION

When you use the Website, including the Services or features made available via the Website, we will collect two types of information from you: Personal Information and Usage Data.  

When you use the Services, we may ask you for Personal Information. You are under no obligation to provide any Personal Information to us, and you may use the Services without providing us with any Personal Information. However, some features of the Services may not function if you choose not to provide us with Personal Information. For example, you will be unable to save properties to a favorite list unless you set up an Account. We collect and use your Personal Information as follows::

  • Registration: When you create an Account to use the Services we collect your first and last name, email address, and a password that you create. We use this information to setup and administer your Account and to provide certain features of the Services, such as saving your favorite properties. You are not required to create an Account to use the Services.
  • Subscribe to our mailing list or newsletter: If you ask to sign up for our mailing list or newsletter, we collect your name and email address in order to provide you with our newsletter, offers, and promotions. If you no longer wish to receive these communications, you can unsubscribe at any time as set forth below in the “Opting Out” section of this Privacy Policy.
  • Use of the Services: When you use the Services, we collect information about your usage of the Services, such as the search criteria you enter, the properties you view and favorite. This information, by itself, may not contain Personal Information, but may be stored in connection with your Personal Information, if you have setup an Account.
  • Payment Information: If you choose to use our lead generation service, we will collect payment card information from you, including but not limited to the payment card number, cardholder’s name, expiration date, and billing zip code. 
  • Communications: If you voluntarily communicate with us, such as sending an inquiry or requesting technical support, we collect your name, Account information, if applicable, email address, and the contents of your request or communication. We use this information to respond to your request or inquiry.
  • Personalize/Improve the Services: We use your Personal Information to improve your use of the Services and personalize the Services to match your profile or interests, including showing you targeted advertising based on your interests as described below in the “Targeted Advertising” section or displaying available properties based on your location. 
  • Information obtained from third parties: We may collect Personal Information about you from third parties in the following situations: 
  • If you interact with Blimp on social media, we may obtain your username, profile information, and the contents of your interaction.
  • If your contact shares a property featured on the Services with you, we collect your email address from your contact in order to send you information about the property, either through email or the App, if you have registered to use the App.
  • If you interact with the Services via a third-party account or service (e.g. your Google account), we collect information about that account, including your name and username, in order to allow the interaction.

When you use the Services, we collect and use your Usage Data as follows:

When you access the Website and use the Services, we may gather Usage Data about you or your device by automated means (see the section describing Cookies and Similar Technologies below). We use your Usage Data to help us analyze trends, monitor and improve the Services, and tailor the Services to you. This Usage Data includes:

  • the browser, operating system, and software used by your device to access the Website;
  • your internet protocol (IP) address;
  • your general location information associated with your IP address; and
  • your interaction with the Services, such as the pages and advertisements you view, links clicked, the keywords you searched, date and time you accessed the Website, duration of your visit, and referring page;


COOKIES AND SIMILAR TECHNOLOGIES

We may use “cookies” or similar technology on the Website. “Cookies” are small text files sent by web servers to be stored on the computers of website users. These files often contain personalization settings or unique identifiers so that your computer or device can be recognized the next time you access the Website or use the Services. Cookies track your use of the Services and may also reflect demographic data pertaining to you or other data linked to information you submit through the Services. We use cookie data to improve your experience with the Website, log you on to your Account, and analyze your use of the Services. Cookies alone do not personally identify individuals or contain any Personal Information. Most web browsers automatically accept cookies, but you may be able to change your browser settings to prevent accepting cookies or display a warning before cookies are accepted. If you choose to disable the acceptance of cookies from the Website, certain features of the Website or Services may not function properly. Some of our advertisers and third-party service providers may also utilize their own cookies.

In addition, we may use certain technologies in the Services, including without limitation “web beacons”, “clear GIFs”, “pixels” and/or “tags”, that allow us to gather data, such as measuring Website and page traffic, monitoring your interaction with emails we send, understanding user interests and activity, gathering related information (such as information relating to a particular browser, device or IP address) and positioning images, and typically do so without detracting from your online experience. These technologies do not collect information that could be used to personally identify you. 


SHARING OF PERSONAL INFORMATION

We do not sell or rent your Personal Information without your express consent. We only share your Personal Information to third parties as described below or permitted by applicable law. When we share your Personal Information, we only share the specific data needed to accomplish the purpose for which the Personal Information was shared. We disclose your Personal Information in the following circumstances:

  • Service Providers: Like most businesses, we share your Personal Information with third parties that perform services to us or on our behalf. Those service providers are contractually restricted to only use your Personal Information for the purpose for which it was shared. We engage the following types of service providers:
  • We use a third-party marketing provider to send you newsletters, electronic notices, and other emails;
  • Usage Data regarding your use of the Website is collected by Google Analytics;
  • Our website hosting provider may have access to Personal Information you enter into the Website;
  • Your username, password, and other Personal Information in your Account is shared with our Account login authenticator; and
  • If you provided us with payment card information, we will share your payment information with our payment processor.
  • Affiliates: We share your Personal Information with our Affiliates for the purpose of making the Services available to you or linking your Account with your use of the Blimp App.
  • Other Users: Both our App and Services are designed to facilitate collaboration between consumers and real estate professionals. When you specifically request, we will provide your Personal Information to other users of the App or Services, such as in the following situations:
  • If you wish to share property listings with other users of the App or Services, such as real estate professionals or prospective buyers, we will also share your name and email address to identify you as the sender of the listing.
  • If you are a consumer and your Account is connected to your real estate professional’s Account via the Services, we will share information about the properties you have viewed and the searches you have conducted in order to assist your real estate professional in locating properties that may be of interest to you.
  • Referrals/Leads: If you are a consumer looking to connect with a real estate professional, we will share your Personal Information with real estate agents, mortgage brokers, attorneys, or other real estate professionals only when you expressly direct us to connect you with such professionals. We may receive a lead generation fee or a referral fee as is customary in the traditional model of brokerage referral relationships. Such fee does not constitute a sale under privacy laws.
  • Advertising: From time to time we may display relevant advertising on the Website, such as advertising for real estate-related services or professionals. If you express an interest in such service or professional, we will share your Personal Information so you may be provided with the information or service you requested.
  • Legal and Compliance: We may share your Personal Information in response to a search warrant, court order, or other legally valid process or order to law enforcement or other government agencies. Your Personal Information may also be disclosed where necessary for the establishment, exercise, or defense of legal claims.
  • Safety and Security: We may disclose your Personal Information, if we determine in our sole but reasonable discretion that disclosure is necessary to: (a) protect and defend our rights or property; (b) protect and defend the rights or security of our employees, contractors, or other users; (c) prevent or investigate unauthorized use of the Services, security breaches, or other wrongdoing; (d) prevent, detect, or investigate fraud, or (e) as otherwise required or permitted by law.  
  • Merger or Sale of Business: We may transfer any information we have about you as an asset in connection with, or during negotiations of, a proposed or completed merger, acquisition, consolidation, or sale (including transfers made as part of insolvency, liquidation, or bankruptcy proceedings) involving all or part of Blimp or as part of a corporate reorganization or other change in corporate control.
  • Consent: We may disclose your Personal Information to other third parties with your consent.


THIRD PARTY SITES

The Services may contain links to Third-Party Sites. If you visit any Third-Party Sites linked from the Services, they may collect Personal Information about you. We do not control or endorse those Third-Party Sites, nor are we responsible for their collection or use of your Personal Information, their privacy practices, or any material, advertising, or services available on the Third-Party Sites. You should read the privacy policy of any Third-Party Site prior to providing Personal Information. Any questions about a Third-Party Site’s information collection practices should be directed to the administrator of that Third-Party Site.


CHILDREN’S PRIVACY

The Services are not intended for anyone under the age of 16 nor do we knowingly collect Personal Information from anyone under the age of 16. Children are not eligible to create or use an Account. If we discover we have collected Personal Information from anyone under the age of 16, we will immediately delete such information. If you believe your child may have provided us with Personal Information without your consent, please contact us at info@blimphomes.com


PROTECTION OF YOUR PERSONAL INFORMATION

We have implemented industry standard administrative, technical, procedural, and physical security measures in an effort to safeguard the Personal Information in our custody and control against theft, loss and unauthorized access, use, modification, and disclosure. We restrict access to Personal Information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements or service and who have been instructed on the confidential nature of the Personal Information.

You should know, however, that due to the open communication nature of the Internet, no transmission is 100% secure. We cannot guarantee that your transmissions to the Website and any Personal Information you enter into the Services will be free from unauthorized access by third parties. You enter Personal Information into the Services at your own risk.

You are responsible for maintaining the confidentiality of your Account username and password and other Account information in order to prevent unauthorized access to and use of your Account. If you believe your password has been compromised, you should change it immediately. 


INFORMATION RETENTION

We will retain your Personal Information for as long as is required by law or our record retention policy, is necessary to fulfill the purpose for which we collected the Personal Information, or to resolve disputes or enforce our rights and policies. You may request that we delete your Personal Information in accordance with the “Correcting or Deleting Your Personal Information” section below.

We may retain information about you that has been anonymized or deidentified, including your Usage Data, for internal purposes for an indefinite period of time. 


OPTING-OUT

As indicated above, if you have signed-up to receive our email communications, you can unsubscribe any time by clicking the “unsubscribe” link included at the bottom of the newsletter. Alternatively, you can opt-out of receiving our marketing communications by contacting us using the information under the “Contact Us” section below. However, you may not opt-out of some communications, including important announcements, legal notices, communications about Account changes or upgrades to the Services, notifications of changes to our Privacy Policy or Terms of Use, or service-related communications.


CORRECTING OR DELETING YOUR PERSONAL INFORMATION

Subject to limited exceptions under applicable law, you have the right to access, update, and correct inaccuracies in your Personal Information in our custody and control. You may access, update, or correct the Personal Information in your Account by logging into your Account at any time. You may also request access, updating, and corrections of inaccuracies in your Personal Information in our custody or control by emailing or writing to us at the contact information set out below. We may request certain Personal Information for the purpose of verifying the identity of the individual seeking access to his or her Personal Information records. We are not required to fulfill unreasonable requests.

You may delete some Personal Information at any time by logging into your Account or sending a request to us. However, we must retain some of your Personal Information in order to continue to provide your Account or the Services, such as your name, email address, password, and payment information, if applicable. If you request that we delete your Personal Information and we have no legitimate business purpose to retain it, we will delete your Personal Information once we are able to verify your identity.


TERMINATING YOUR ACCOUNT

You may request that Blimp delete your Account to use the Services at any time by contacting accounts@blimphomes.co. Once Blimp is able to confirm your identity, your Account will be terminated and all Personal Information associated with your account will be deleted, unless Blimp is required by law to retain any Personal Information. Blimp may retain nonpersonal information about your usage of the Services after your Account is terminated.


SOCIAL NETWORKING

Our Website or Services may include a feature that allows you to view or share content on social networks by initiating contact with such social network or allowing you to repost material on the social network. When you initiate contact with a social network through our Website, you will be redirected to that social network, and our Website may collect your social network profile information. 

By referencing or “tagging” Blimp or using hash tags that alert or identify Blimp in any social media posts, you consent to the publication or reposting of such material on our Website or on the Blimp social media accounts. Any information we collect from you via your use of social features is subject to this Privacy Policy, unless provided otherwise in writing. The social network site you choose to visit may also collect information from you. We are not responsible for their use of your Personal or non-personal information. You should review the privacy policies of any social networks you visit for more information on their use of your information.   


TARGETED ADVERTISING; DO NOT TRACK SIGNALS

Blimp does not track your browsing activity across other websites or applications. We do, however, allow third-party advertisers to use tracking technology such as cookies, pixels, and web beacons (as described in the “Cookies” section of this Privacy Policy) to display advertising of products or services that may be relevant to you based on your browsing activity or location. These third parties may also monitor your interaction with their advertisements to measure effectiveness and personalize future advertising content. We do not provide your Personal Information to third-party advertisers without your consent. 

Certain web browsers feature a “Do Not Track” mechanism which sends a signal to the website not to track the user’s activity. Because there is not a universal understanding of how to respond to “Do Not Track” signals, our Website does not recognize or respond to such “Do Not Track” requests from Internet browsers. 


INTERNATIONAL USERS

The Website is operated from our facility located in the U.S. but may be accessed from anywhere in the world. If you access the Website or use the Services outside of the U.S., your Personal Information will be transferred to, and stored on, servers located in the U.S., where the data protection laws may not be as comprehensive as those in your country of residence. By using the Services and providing any Personal Information, you consent to the transfer, storage, and continued use of your Personal Information in the U.S. 

We make no representation and take no responsibility for any applicable laws and regulations outside the U.S. Persons who choose to access the Services from locations outside the US do so at their own discretion and initiative and are responsible for compliance with local applicable laws.


YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident, you have additional rights with regards to your Personal Information. This section only applies to California residents. For the purpose of this California Residents’ Rights Statement, Personal Information does not include:

  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA); and
  • Personal information covered by industry-specific privacy laws, including the Gramm-Leach-Bliley Act (GLBA), Fair Credit Reporting Act (FCRA), Driver’s Privacy Protection Act of 1994, and California Financial Information Privacy Act (FIPA)

A. Shine the Light Disclosures: Under California Civil Code Section 1798.83 (the “Shine the Light” law), California residents who provide certain Personal Information in connection with obtaining products or services for personal, family, or household use are entitled to request and obtain the following from us: (i) a list of the categories of Personal Information that we have disclosed to third parties during the immediately preceding calendar year for the third parties' direct marketing purposes, and (b) the names and addresses of all such third parties.

B. California Consumer Privacy Act (CCPA) Disclosures: Residents of California have certain rights under the California Consumer Privacy Act (“CCPA”) (Cal. Civ. Code §1798.100 et seq.), including the right to know what Personal Information we have collected about you, to whom the Personal Information has been disclosed or sold, and how you can review or delete your Personal Information.

Personal Information collection requires that we disclose, among other things, the categories of Personal Information we have collected from California residents in the previous twelve (12) month period and the source. Disclosure of Personal Information 

In the preceding twelve (12) months, we have disclosed the following categories of Personal Information, as defined in the table above, to third parties:

  • third parties that provide services to us, including but not limited to sending our newsletter, hosting our website and email, and authenticating your account; and
  • other Users of the Website, when you expressly direct us to connect you with other Users;

Sale of Personal Information

Blimp has not sold (as that term is defined in the CCPA) any Personal Information of any California residents within the past twelve (12) months.

Your Rights

Pursuant to the CCPA, California residents have the right to request from us, for the preceding twelve (12) month period: 

  1. the categories of Personal Information and the specific pieces of Personal Information that we have collected about the resident, 
  1. the categories of sources from whom the Personal Information was collected, 
  1. our purposes for collecting the Personal Information,
  1. the categories of third parties with whom we have shared the Personal Information, and
  1. the categories of Personal Information that was sold or disclosed, if any, for a business purpose.


You also have the right to request that we delete any Personal Information we have collected from you from our records, or the records of third parties with whom we have shared your Personal Information. Once we verify your request, we will delete any Personal Information from our records, unless retaining your Personal Information is necessary for us to:

  • perform the business purpose for which we were provided the Personal Information, such as processing your claim;
  • offer employment or provide employment benefits;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity;
  • debug to identify and repair errors that impair existing intended functionality; 
  • exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law;
  • comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
  • enable solely internal uses that are reasonably aligned with your reasonable expectations based on your relationship with us;
  • comply with a legal obligation; or 
  • fulfill other internal and lawful uses of your Personal Information that are compatible with the context in which you provided your Personal Information.


Please note that if we received your Personal Information from a third party, you will need to send your request to delete your Personal Information to that third party.

We will confirm receipt of right to know and deletion requests within ten (10) business days of receiving such requests and will provide information as to how we will process such requests. We will respond to verified requests within forty-five calendar (45) days of receipt. Please note that we are only required to respond to each website visitor twice per twelve (12) month period.

We are not required to: (1) retain any Personal Information about you that was collected for a single, one-time transaction if, in the ordinary course of business, that information about you is not retained; or (2) reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered Personal Information.

When you contact us, you will need to provide us with enough information to identify you (e.g., your full name, address, Account information); proof of your identity and address; and a description of what right you want to exercise and the information to which your request relates.

We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf. Any Personal Information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

Upon verification, we will provide the requested information to you within the time period noted above. The information will be provided to you free of charge. We will not discriminate against you for exercising your rights under this section.


UPDATES TO THE PRIVACY POLICY

We may update this Privacy Policy periodically to reflect changes to our privacy practices. If we update this Privacy Policy, we will notify you by posting the new Policy here and updating the Effective Date at the top of this Privacy Policy. By using the Services and/or providing us with any Personal Information after any changes to this Privacy Policy, you consent to the new terms. It is your responsibility to periodically review this page to ensure you are familiar with those changes.

Your use of the Services is also subject to our Terms of Use, including but not limited to its usage restrictions, disclaimers, limitations on liability, governing law, and proper venue. You should read it carefully.
